The Supreme Court yesterday limited the Environmental Protection Agency's authority to set standards when it comes to greenhouse gas emissions for power plants. Now in a 63 ruling, the court said that Congress, not the E. P. A. Has the power to create a system of cap and trade regulations all to limit carbon emissions from existing power plants. Chief Justice john roberts writing for the majority quote capping carbon dioxide emissions at a level that will force a nationwide transition away from the use of coal all to generate electricity. Might be a sensible solution for the crisis of the day. But it's not plausible that Congress gave the E. P. A. The authority to adopt on its own such a regulatory scheme. Now, Justice Elena Kagan wrote in a dissenting opinion quote, The court appoints itself instead of Congress or the or the expert agency as the decision maker on climate policy. And I can't think of more things more frightening While the decision puts a risk in President Biden's goal of running the US power grid on clean energy by 2035. Making the entire economy carbon neutral by 2050. It's also latest battle between Republican states and the fossil fuel industry against a Democratic administration trying to limit the impact of climate change. The U. S.
